Terms of Use

1. Acceptance of Terms

By accessing or using loversday.in (the "Service") operated by LoversDay ("we", "us", "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must discontinue use of the Service immediately. These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. Users between 13 and 18 years old must have consent from a parent or legal guardian. We do not knowingly provide services to individuals under 13.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate, current, and complete information during registration and keep it updated.
• You may not create more than one personal account, transfer your account to another person, or use someone else's account.
• Guest accounts are temporary. Content created on a guest account may be permanently deleted after 30 days of inactivity. We are not liable for any loss of data on guest accounts.
• You must notify us immediately at support@loversday.in upon becoming aware of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Post, share, or transmit content that is harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Upload or transmit viruses, malware, or any malicious code.
• Attempt to gain unauthorized access to any part of the Service or its servers.
• Impersonate any person or entity or falsely represent your affiliation with a person or entity.
• Collect or harvest personal information from other users without their consent.
• Use automated tools (bots, scrapers, crawlers) to access the Service without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Engage in any form of spam, phishing, or unsolicited messaging.
• Use the Service to distribute adult content involving minors.

We reserve the right to immediately terminate accounts found in violation of these rules.

5. User-Generated Content

The Service allows you to create, upload, and share content including quiz questions, answers, and messages ("User Content"). You retain ownership of your User Content. By posting User Content, you grant LoversDay a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content.
• Your User Content does not infringe any third-party intellectual property rights.
• Your User Content does not violate these Terms or any applicable law.

We reserve the right to remove any User Content that violates these Terms without notice or liability.

6. Quizzes & Responses

• Quiz creators are solely responsible for the content of their quizzes.
• By sharing a quiz link, the creator acknowledges that anyone with the link may take the quiz.
• Response data (scores, answers) is visible to the quiz creator only. Respondents' identities are shown only if they are logged in.
• We do not guarantee that quiz results are scientifically accurate or professionally valid. All quizzes are for entertainment purposes only.

7. Credits & Payments

• The Service offers a virtual credit system for premium features.
• Credits are purchased via Razorpay and are non-refundable unless required by applicable law.
• Credits have no cash value and cannot be transferred to another account.
• We reserve the right to modify credit pricing, feature costs, and availability at any time with 7 days' notice.
• Credits in terminated accounts are forfeited.

8. Messaging Feature

• The chat/messaging feature is available to registered (non-guest) users only.
• Vanish messages are designed to be delivered once and then permanently deleted from our servers. However, recipients may take screenshots before deletion. We are not responsible for any reproduction of vanish message content by recipients.
• You must not use the messaging feature to harass, threaten, or send unsolicited messages to other users.
• We reserve the right to review messages flagged by users or automated systems for safety purposes.

9. Intellectual Property

The Service, including its original content (excluding User Content), features, design, and functionality, is and will remain the exclusive property of LoversDay. The LoversDay name, logo, and all related brand elements are our trademarks. You may not use them without our prior written consent.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, LoversDay and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the last 12 months.

12. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms which, by their nature, should survive termination (including ownership provisions, disclaimers, indemnity, and limitations of liability) shall survive.

You may delete your account at any time by contacting support@loversday.in.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India. If you use the Service from outside India, you are responsible for compliance with local laws.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, sending an email to your registered address. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
